To provide an opportunity for Members and Officers to declare any personal and/or prejudicial interests in any item on the agenda

15.

Public Speaking Time/Open Session

In accordance with Procedure Rules Nos.11 and 35 a period of 10 minutes is allocated for members of the public to address the meeting on any matter relevant to the work of the meeting. Individual members of the public may speak for up to 5 minutes but the Chairman will decide how the period of time allocated for public speaking will be apportioned where there are a number of speakers. Members of the public are not required to give notice to use this facility. However, as a matter of courtesy, a period of 24 hours’ notice is encouraged.

 

Members of the public wishing to ask a question at the meeting should provide three clear working days’ notice, in writing, in order for an informed answer to be given.

Local Development Framework: Annual Monitoring Report pdf icon PDF 63 KB

To consider the approval of the Annual Monitoring Report for submission to the Government Office for the North West.

Minutes:

The Cabinet Member for Performance and Capacity considered a report which set out the main findings of the Annual Monitoring Report and sought approval for its submission to the Secretary of State by 31st December 2009.

 

The Council was required to submit an Annual Monitoring Report to the Secretary of State in respect of the implementation of Saved Local Plans and any Local Development Documents during 2008/2009. This year’s report covered the period 1st April 2008 – 31st March 2009 and related to the performance of the four former local authorities and their Local Plans.

 

RESOLVED

 

That the Annual Monitoring Report be approved for submission to the Government Office for the North West.

Draft Over Peover Supplementary Planning Document pdf icon PDF 49 KB

To consider the approval of the draft Over Peover Supplementary Planning Document for the purposes of public consultation.

Minutes:

The Cabinet Member for Performance and Capacity considered a report which sought approval of the draft Over Peover Supplementary Planning Document for the purpose of public consultation.

 

The Cheshire East Local Development Scheme committed the Council to producing the Over Peover Supplementary Planning Document in conjunction with the Over Peover Parish Plan Group.  The draft document had now been agreed with the Parish Plan Group and had also been agreed by the Local Development Framework Panel at its meeting held on 16th November 2009. Once adopted, it would be a material consideration in the determination of planning applications.

 

RESOLVED

 

That the draft Over Peover Supplementary Planning Document be approved for the purpose of a statutory six week period of public consultation.

To consider the approval of the draft Prestbury Supplementary Planning Document for the purpose of public consultation.

The Cabinet Member for Performance and Capacity considered a report which sought approval of the draft Prestbury Supplementary Planning Document for the purpose of public consultation.

 

The Cheshire East Local Development Scheme committed the Council to producing the Prestbury Supplementary Planning Document in conjunction with the Prestbury Parish Plan Group. The draft document had been considered and agreed by the Local Development Framework Panel at its meeting held on 16th November 2009. Once adopted, it would be a material consideration in the determination of planning applications.

That the draft Prestbury Supplementary Planning Document be approved for the purpose of a statutory six week period of consultation.

Draft Smallwood Village Design Statement Supplementary Planning Document pdf icon PDF 59 KB

To consider the approval of the draft Smallwood Village Design Statement Supplementary Planning Document for the purposes of public consultation.

The Cabinet Member for Performance and Capacity considered a report which sought approval of the Smallwood Village Design Statement Supplementary Planning Document.

 

The Cheshire East Local Development Scheme committed the Council to producing the Smallwood Village Design Statement Supplementary Planning Document.

 

Over the previous six to nine months, Planning Officers had worked closely with Smallwood Parish Council on the preparation of the Village Design Statement.  The purpose of the document was to assist in the interpretation of policies adopted within the Congleton Borough Local Plan First Review (2005) and saved as part of the Local Development Framework.  Once adopted, it would be a material consideration in the determination of planning applications.

 

RESOLVED

 

That the draft Smallwood Village Design Statement Supplementary Planning document be approved for a statutory six week period of public consultation.

Draft Local List Supplementary Planning Document pdf icon PDF 50 KB

To consider the approval of a draft Local List Supplementary Planning Document for the purpose of public consultation.

Minutes:

The Cabinet Member for Performance and Capacity considered a report which sought approval of the Local List Supplementary Planning Document for the purpose of public consultation.

 

The Cheshire East Local Development Scheme committed the Council to producing a Local List Supplementary Planning Document to identify locally important buildings, i.e. non-listed buildings and other structures of architectural or historic interest, which did not have the full protection of statutory listing and were deemed worth of retention. The document, once adopted, would be a material consideration in the determination of planning applications.

 

The Supplementary Planning Document had been considered by the Local Development Framework Panel at its meeting held on 16th November 2009, following which a number of minor changes had been made.

 

RESOLVED

 

That the draft Local List Supplementary Planning Document be approved for the purpose of a statutory six week period of public consultation.

22.

Cheshire Replacement Waste Local Plan – Saved Policies pdf icon PDF 280 KB

To consider the Local Planning Authority’s recommendations for saving the policies of the Cheshire Replacement Waste Local Plan beyond July 2010.

Minutes:

The Cheshire Replacement Waste Local Plan had been adopted on 12th July 2007, and its policies were saved until 11th July 2010.  However, saved policies ceased to be part of the development plan after three years unless extended by the Secretary of State.  

 

The Cabinet Member for Performance and Capacity considered a report which set out the Local Planning Authority’s recommendations for saving the policies of the Cheshire Replacement Waste Local Plan beyond July 2010. 

 

RESOLVED

 

That

 

(a)               the recommendation to save all the policies of the Cheshire Replacement Waste Local Plan be endorsed;

 

(b)               a request be submitted to the Secretary of State to save the policies of the Cheshire Replacement Waste Local Plan beyond July 2010;

 

(c)               the basis of the submission be as identified in Appendix 2 of the report submitted;

 

(d)               owing to the geographic nature of the document, spanning two Authorities, a joint submission be submitted to the Secretary of State from Cheshire East and Cheshire West and Chester;

 

(e)               an urgent review of waste site allocations for Cheshire East be carried out at the earliest opportunity in 2010 to take account of any changes in circumstances since the original adoption of the Cheshire Replacement Waste Local Plan; and

 

(f)                 a report, setting out how such a review might be undertaken, including timescales, resources and options, be presented to the next meeting of the Local Development Framework Panel.
