Application for a Premises Licence - Craft Ale Bar, Castle Street, Nantwich CW5 5BA To consider an application for a Premises Licence by Peter Terry in respect of Craft Ale Bar, Castle Street, Nantwich, Cheshire CW5 5BA. Additional documents:
Minutes: The Sub-Committee considered a report regarding an application for a Premises Licence for Craft Ale Bar, Castle Street, Nantwich CW5 5BA.
The following attended the hearing and made representations with respect to the application:
· three representatives of the applicant
The Sub-Committee was informed that the interested party who had submitted an objection was unable to attend the meeting. Following advice from the Lawyer present at the meeting, the Sub-Committee agreed to proceed in the absence of the interested party.
After a full hearing of the application and in accordance with the rules of procedure, the Chairman of the Sub-Committee reported that, after taking account of:
· The Secretary of State’s Guidance under section 182 of the Licensing Act 2003 · Cheshire East Borough Council’s Statement of Licensing Policy · The four licensing objectives (namely the prevention of crime and disorder, public safety, the prevention of public nuisance, and the protection of children from harm) · All the evidence, including the oral representations made at the meeting and the written representations of interested parties
the following course of action had been agreed:
RESOLVED - That the application for a premises licence be granted for the sale and supply of alcohol on and off the premises from Monday to Sunday between 10.00 and 22.00 hours, subject to:
(a) The imposition of the measures contained within the operating schedule, as set out in the Application, as conditions of the licence.
(b) The following agreed conditions requested by Cheshire East Council’s Environmental Protection Team:
· No music is to be played in the outside drinking area. · Noise emanating from the premises shall not cause a nuisance at the boundary of any residential premises. · All external windows and doors shall be closed whilst entertainment is taking place, except for normal access and egress. · There shall be notices located at the exit(s) requesting that customers leaving the premises do so quietly and with consideration to neighbours. · There shall be no disposal of bottles outside the premises between the hours of 20.00 and 08.00. · At the close of business each day, the outside area shall be left clear of litter and bottles and any tables and chairs shall be taken inside
(c) The following discretionary condition:
The Designated Premises Supervisor and/or his staff will patrol the licensed area hourly during the operation of the licensable activity so as to routinely and continually monitor and ensure the proper behaviour of customers especially in the outside area and immediately outside the entrance.
The Applicant and Parties who had made relevant representations were reminded of their right to appeal this decision to the Magistrates’ Court within 21 days of service of the written notice of the decision.
