RESOLVED –That Councillor S Davies be appointed Chairman.

To consider an application for a Premises Licence by Shell UK Oil Products Ltd in respect of Shell Dean Row, Adlington Road, Wilmslow SK9 2LN.

The Sub-Committee considered a report regarding an application for a Premises Licence for the premises known as Shell Dean Row, Adlington Road, Wilmslow.

 

The following attended the hearing and made representations with respect to the application:

 

·         A representative of the applicant

 

After a full hearing of the application and in accordance with the rules of procedure, the Chairman of the Sub-Committee reported that, after taking account of:

 

·         The Secretary of State’s Guidance under section 182 of the Licensing Act 2003

·         Cheshire East Borough Council’s Statement of Licensing Policy

·         The four licensing objectives (namely the prevention of crime and disorder, public safety, the prevention of public nuisance, and the protection of children from harm)

·         All the evidence, including the oral representations made at the meeting and the written representations of interested parties

 

the following course of action had been agreed:

 

RESOLVED

 

(a)       That the application for a premises licence be granted as follows:

 

Late Night Refreshment (Indoors)

Monday to Sunday – 23:00 to 05:00

 

            Sale of Alcohol

            Monday to Sunday – 24 hours (for consumption off the premises)

 

            Hours the premises is open to the public

            Monday to Sunday – 24 hours

 

(b)       That the following condition be imposed on the licence, as requested by Cheshire Police and agreed by the applicant’s representative:

 

The site will operate a closed door policy, whereby the entrance to the shop will be closed to customers between the hours of 24.00 and 05.00 hours each day.  All sales between these hours will be made through the night pay window.

 

(c)       That a further condition be imposed on the licence agreed by the applicant’s representative:

 

Late Refreshment Monday to Sunday 23.00 hours to 05.00 is restricted to the sale of hot beverages only.

The Applicant’s representative was reminded of their right to appeal this decision to the Magistrates’ Court within 21 days.
