Application to Vary a Premises Licence - Boars Head, Walgherton, Nantwich CW5 7LA To consider an application to vary a Premises Licence submitted by Orange Tree Bar and Grill Limited in respect of Boars Head, Walgherton, Nantwich CW5 7LA. Additional documents:
Minutes: The Sub-Committee considered a report regarding an application to vary a Premises Licence for The Boars Head, Walgherton, Nantwich CW5 7LA.
The following attended the hearing and made representations with respect to the application:
· a representative of the applicant · a local resident
After a full hearing of the application and in accordance with the rules of procedure, the Chairman of the Sub-Committee reported that, after taking account of:
· The Secretary of State’s Guidance under section 182 of the Licensing Act 2003 · Cheshire East Borough Council’s Statement of Licensing Policy · The four licensing objectives (namely the prevention of crime and disorder, public safety, the prevention of public nuisance, and the protection of children from harm) · All the evidence, including the oral representations made at the meeting and the written representations of interested parties
the following course of action had been agreed:
RESOLVED - That the application to vary a premises licence be granted as applied for. Namely:
1. An addition of a further licensable activity of late night refreshment between 23:00 hours and 00:00 daily.
2. The internal layout of the premises is varied in accordance with the deposited plan.
3. Four existing conditions at Annex 2 of the Licence, namely: · ‘Children not allowed on the premises after 9.30pm’ · ‘No amplified music’ · ‘The cigarette machine to be positioned to be clearly visible from behind the bar servery’ and · ‘a no smoking area for family use’ are removed forthwith.
Subject to the following conditions being added at Annex 3 of the licence:
· The licence holder is to take measures to ensure that music will not be audible above background level at the nearest noise sensitive location.
· The licence holder is to undertake routine monitoring to ensure external levels of music are not excessive and take action where appropriate.
· There shall be placed at all exits from the premises in a place where they can be seen and easily read by the public, notices requiring customers to leave the premises and the area quietly.
· The placing of refuse – such as bottles - into receptacles outside the premises to take place at times that will minimise the disturbance to nearby properties.
· No adult entertainment will be provided at any time on the premises.
The Applicant and Parties who had made relevant representations were reminded of their right to appeal this decision to the Magistrates’ Court within 21 days.
