Regularisation of Market Provision

30/07/2012 - Regularisation of Market Provision

Consideration was given to a report on the legal position in relation to the methods by which market rights may be established together with information in relation to the existing markets at Alsager, Knutsford, Middlewich, Nantwich, Sandbach and Wilmslow. The report requested the consolidation of the existing market rights by the application of the powers within Part III of the Food Act 1984 (as amended).

 

RESOLVED

 

That

 

(1) without prejudice to the Council’s existing market rights however acquired, Markets be established in Alsager, Knutsford, Middlewich, Nantwich, Sandbach and Wilmslow under Part III of the Food Act 1984 (as amended).

 

(2) the markets at Alsager and Sandbach shall come into force only if the Certificate of Lawfulness of Existing Use or Development is granted by the Local Planning Authority.

 

(3) the resolution (1) above shall only come into force in respect of the markets named which do not place on the highway or for which the consent of the Highway Authority has already been provided in respect of those markets or a Traffic Regulation Order (if applicable) has been made.
