To consider an application to vary a Premises Licence in respect of Six Bar & Grill, 6 Crewe Road, Alsager ST7 2ES.

The Sub-Committee considered a report regarding an application to vary a Premises Licence for Six Bar & Grill, 6 Crewe Road, Alsager ST7 2ES.
The following attended the hearing and made representations with respect to the application:

After a full hearing of the application and in accordance with the rules of procedure, the Chairman of the Sub-Committee reported that, after taking account of:
• The Secretary of State’s Guidance under section 182 of the Licensing Act 2003
• Cheshire East Borough Council’s Statement of Licensing Policy
• The four licensing objectives (namely the prevention of crime and disorder, public safety, the prevention of public nuisance, and the protection of children from harm)
• All the evidence, including the oral representations made at the meeting and the written representations of interested parties, the following course of action had been agreed:
RESOLVED - That the application to vary a premises licence be granted, subject to the following agreed amendments to the times of Licensable Activities and conditions:

Conditions:
• There will be no entertainment provided in any external area at the premises.
• No person under 18 years of age may enter or remain on the premises after 22:00 hours.
• The Premises Licence Holder will ensure that a comprehensive risk assessment is conducted, at intervals of not more than 31 days, into the need for door supervisors to be on duty at the premises. This risk assessment will be recorded in writing, produced to a constable or authorised officer of the local authority on request, and a copy retained at the premises for a period of at least 6 months from the date of the assessment.
• When door supervisors are utilised at the premises they will be sourced from a company who is currently accredited under the Security Industry Authority ‘Approved Contractor Scheme’.
• A CCTV system shall be installed at the premises to the satisfaction of the Police Licensing Officer and it will record at all times the premises are open to the public. Unedited recordings must be securely stored on site for a period of at least 28 days and copies immediately made available, upon receipt of a lawful request to do so, to a constable or an employee of the Licensing Authority.
• All access and egress for customers after 18:00 hours will take place using the main entrance off Crewe Road and the rear access into the external area will be secured so as to prevent access from 18:00 hours.
• Customers who wish to observe the ban on smoking in public places will be required to use the external area at the rear of the premises and not the footpath on Crewe Road at the front of the building.
As a consequence of variation application itself and the replacement of more onerous conditions than those presently on the premises licence the following existing conditions, from Annex 2 of the premises licence, are to be deleted/replaced: 1., 2., 4., 6., 7.
Both existing conditions numbered 3. and 5. will remain unchanged.
The Applicant and Parties who had made relevant representations were reminded of their right to appeal this decision to the Magistrates’ Court within 21 days.
