Appointment of Chair

To appoint a Chair for the meeting.

RESOLVED:

 

That Councillor Arthur Moran be appointed as Chair.

Declaration of Interests

To provide an opportunity for Members and Officers to declare any disclosable pecuniary interests, other registerable interests, and non-registerable interests in any item on the agenda and for Members to declare if they have pre-determined any item on the agenda.

In the interests of openness and transparency, the following declarations were made:

 

Councillor John Place declared that he had been customer of the bars referenced in the application.

The Sub-Committee considered a report for an application for to vary a premises licence for the premises known as Mia's Treacle Bites, 87 Mill Street, Macclesfield, SK11 7NN.

 

The following attended the hearing and spoke in relation to the application:

 

Martin Kinduff - Licensing Enforcement Officer

Svetozar Rankov - Applicant

Dominc Loftus - Applicant’s colleague

 

After a full hearing of the application and in accordance with the rules of procedure, the Chair of the Sub-Committee reported, that after taking account of:

 

·         The oral and written representations made by all parties to the hearing.

·         The licensing objective of the prevention of public nuisance.

·         The Secretary of State’s Guidance under the Licensing Act 2003 (Dec 2022).

·         Cheshire East Council’s Statement of Licensing Policy

 

The following course of action had been agreed:

 

RESOLVED:

 

That the application to vary the license be granted, subject to the mandatory conditions applied to all premises licenses by operation of law, and to the hours and the additional conditions set out below:

 

Hours

 

Opening Hours:

Mon–Thu: 07:00–01:00

Fri–Sat: 07:00–02:30

Sun: 08:00–20:00

Non-standard: New Year’s Eve - 24 hours.

 

Supply of Alcohol (on-sales):

Mon–Thu: 12:00–00:30

Fri–Sat: 12:00–02:00

Sun: 08:00–20:00

 

Live Music (indoors):

Mon–Thu: 20:00–12:30

Fri–Sat: 20:00–02:30

Non-standard: New Year’s Eve extended.

 

Plays - No variation necessary

 

Additional Conditions

 

Door Supervisors: A minimum of two SIA-licensed door supervisors (who shall be clearly identifiable as such from their attire) shall be on duty from 22:00 until closing on Fridays and Saturdays, and on duty whenever live music continues beyond 00:00.

 

Doors and Windows: All external doors and windows shall remain closed during amplified music except for access and egress.

 

Live Music Hours: Live music shall cease at 00:00 Sunday–Thursday and 01:00 Friday–Saturday. After these times, only background recorded music at a level inaudible outside the premises shall be permitted.

 

CCTV: A digital CCTV system shall cover all public areas, with recordings retained for 31 days and made available to Police or Licensing Officers on request.

 

Dispersal Policy: The premises shall operate a written dispersal policy to ensure customers leave quietly and promptly at closing time.

 

No External Speakers: No speakers shall be located outside the premises or in any external area.
