Public Speaking Time/Open Session

In accordance with Procedure Rules Nos.11 and 35 a period of 10 minutes is allocated for members of the public to address the meeting on any matter relevant to the work of the body in question.  Individual members of the public may speak for up to 5 minutes but the Chairman or person presiding will decide how the period of time allocated for public speaking will be apportioned where there are a number of speakers. Members of the public are not required to give notice to use this facility. However, as a matter of courtesy, a period of 24 hours’ notice is encouraged.

 

Members of the public wishing to ask a question at the meeting should provide at least three clear working days’ notice in writing and should include the question with that notice. This will enable an informed answer to be given.

Decision:

1.    Approval be given for the land at Bollington Leisure Centre and adjacent Atax Field, Heath Rd, Bollington, Macclesfield, Cheshire East SK10 5EX (shown edged red on the plan attached to the Report) (‘the Land’) to be advertised as a disposal of public open space.

 

2.    Following the statutory process and due consideration of the responses to the open space advertisements the Portfolio Holder for Regeneration be given delegated authority to determine whether to transfer the Land by way of a 125 year lease to Bollington Town Council. 

 

3.    Any leasehold transfer of the Land shall be on the terms stated in the Report, or such other terms as the Portfolio Holder for Regeneration shall determine in consultation with the Assets Manager and the Director of Legal Services.

 

Minutes:

The Cabinet Member considered a report which detailed a request from Bollington Town Council to transfer land at Bollington Leisure Centre and adjacent Atax Field, Heath Road, Bollington by way of 125 year lease for £1 as part of the Local Service Delivery – Transfer and Devolutions to Town and Parish Councils process.

 

This was a joint venture proposal with Bollington Health and Leisure Trust, known as the Bollington Cross Youth Project with Bollington Health and Leisure Trust and would enable them to enhance the sports and leisure facilities on the site.  It would also allow them to apply for grant funding to complete the project. 

 

The client service had confirmed that the land was not surplus to operational requirements.  However they supported the lease proposal as the proposed project would be beneficial as it would provide enhanced football, leisure and recreational opportunities for Bollington and the local community. 

 

The 125 year lease would be in line with the standard terms that was agreed by Cabinet in September 2015, where the use would be protected, the Town Council would be responsible for the service and asset in the future and it would include an overage provision on the basis that it there was a future planning permission which enhanced the value of the asset or the Town Council sold the asset within a 15 year period with increase in value/proceeds of sale returning to Cheshire East on a reducing sliding scale.

 

RESOLVED:

 

1          Approval be given for the land at Bollington Leisure Centre and adjacent Atax Field, Heath Rd, Bollington, Macclesfield, Cheshire East SK10 5EX (shown edged red on the plan attached to the Report) (‘the Land’) to be advertised as a disposal of public open space.
