Public Speaking Time/Open Session

In accordance with Procedure Rules Nos.11 and 35 a period of 10 minutes is allocated for members of the public to address the meeting on any matter relevant to the work of the body in question.  Individual members of the public may speak for up to 5 minutes but the Chairman or person presiding will decide how the period of time allocated for public speaking will be apportioned where there are a number of speakers. Members of the public are not required to give notice to use this facility. However, as a matter of courtesy, a period of 24 hours’ notice is encouraged.

 

Members of the public wishing to ask a question at the meeting should provide at least three clear working days’ notice in writing and should include the question with that notice. This will enable an informed answer to be given.

Cheshire Extra Care Catering Sub Leases pdf icon PDF 68 KB

To consider the underleases required for catering facilities within Cheshire Extra Care Developments.

Decision:

That Cheshire East Council (CEC) negotiates and agrees Heads of Terms on behalf of both CEC and Cheshire West and Chester (CWAC) in respect of the five underleases required to facilitate the operation of the catering facilities located within the Cheshire Extra Care developments in Crewe (Cheshire East) Handforth (Cheshire East) Middlewich (Cheshire East) Winsford (Cheshire West and Chester) Ellesmere Port (Cheshire West and Chester) and then for CEC to enter into underleases in respect of the properties located in Crewe, Handforth and Middlewich on terms and conditions to be determined by the Asset Manager and Director of Legal Services and to authorise the Director  of Legal Services to draft, negotiate and agree the underleases and proceed to completion of the underleases.

Consideration was given to a report seeking approval to Cheshire East Council (CEC) agreeing Heads of Terms on behalf of both CEC and Cheshire West and Chester Council (CWAC) in respect of five underleases required to facilitate the operation of the catering facilities within Cheshire Extra Care developments.

 

It was reported that in 2007 five Extra Care Housing facilities had been commissioned by Cheshire County Council and the facilities were leased to Manchester and District Housing.  The Catering facilities are operated and financed by CEC and CWAC as successors to Cheshire County Council.  The facilities should have been leased back to the operators to facilitate the catering provision and as there was now a proposal to put the catering service out to tender there was a need for CEC and CWAC to enter into underleases of the areas being used for the catering service, in order to regularise the current position, and allow a further sublease to be granted by the Councils to the successful party in the tender of the catering service.

 

RESOLVED
