Public Speaking Time/Open Session In accordance with Procedure Rules Nos.11 and 35 a period of 10 minutes is allocated for members of the public to address the meeting on any matter relevant to the work of the body in question. Individual members of the public may speak for up to 5 minutes but the Chairman or person presiding will decide how the period of time allocated for public speaking will be apportioned where there are a number of speakers. Members of the public are not required to give notice to use this facility. However, as a matter of courtesy, a period of 24 hours’ notice is encouraged.
Members of the public wishing to ask a question at the meeting should provide at least three clear working days’ notice in writing and should include the question with that notice. This will enable an informed answer to be given.

Land off Maggoty Lane, Gawsworth To consider the transfer of this land to Gawsworth Parish Council. Additional documents: Decision: Subject to the response to public space advertisements, to transfer the long leasehold of land known as Land off Maggoty Lane, Gawsworth, Macclesfield, Cheshire, shown edged red on the plan attached to the report, to Gawsworth Parish Council for a nominal value on the terms stated and such other terms as may be agreed by the Property Services Manager in consultation with the Head of Legal services and Monitoring Officer.
Minutes: An approval was sought to transfer land known as ‘Land off Maggoty Lane, Gawsworth’ to Gawsworth Parish Council, in line with the agreed policy for the transfer of assets and devolution of services to town and Parish Councils.
In 2012 Gawsworth Parish Council acquired an area of woodland on Maggoty Lane to create an area of public open space. This had been incredibly popular and was well used and adjacent to the land in question. The Parish Council had approached the Council to see if it would dispose of the land in question to enable it to enhance the existing open space off Maggoty Lane. The ambition of the Parish Council was to utilise the additional woodland and route of the Ben Brook to allow the public to access more woodland. In addition to this, the Parish Council would also like to be able to utilise part of the land as ancillary space to the woodland.
The Council would secure an overage payment for the Council if there was a future planning permission which enhanced the value of the asset or the Parish Council sold the asset within a 15 year period with increase in value/ proceeds of sale returning to Cheshire East on a reducing sliding scale. The land was surplus to operational requirements and would accord with a number of Cheshire East Councils strategic outcomes.
RESOLVED
Subject to the response to public space advertisements, approval was given to transfer the long leasehold of land known as Land off Maggoty Lane, Gawsworth, Macclesfield, Cheshire, shown edged red on the plan attached to the report, to Gawsworth Parish Council for a nominal value on the terms stated, and such other terms as may be agreed by the Property Services Manager in consultation with the Head of Legal services and Monitoring Officer.
