15.

Public Speaking Time/Open Session

In accordance with Procedure Rules Nos.11 and 35 a period of 10 minutes is allocated for members of the public to address the meeting on any matter relating to the work of the body in question.  Individual members of the public may speak for up to 5 minutes but the Chairman or person presiding will decide how the period of time allocated for public speaking will be apportioned where there are a number of speakers. Members of the public are not required to give notice to use this facility. However, as a matter of courtesy, a period of 24 hours’ notice is encouraged.

 

Members of the public wishing to ask a question at the meeting should provide at least three clear working days’ notice in writing and should include the question with that notice. This will enable an informed answer to be given.

To consider a request to transfer Bollington War Memorial by way of 125 year lease to Bollington Town Council as part of the Local Service Delivery -Transfer and Devolutions to Town and Parish Councils process

Decision:

That, subject to the response to the public space advertisements, Bollington War Memorial, Palmerston Street, Bollington, Cheshire, SK10 5PZ be transferred to Bollington Town Council by way of 125 year lease on the terms as stated in the report and other terms to be agreed by the Property Services Manager.

Minutes:

 

Consideration was given to the transfer of Bollington War Memorial to Bollington Town Council as part of the Local Service Delivery Transfer and Devolutions to Town and Parish Councils process; following the transfer it would be possible for the Town Council to receive a grant for its restoration and refurbishment.

 

Cabinet had previously decided that a number of properties should be transferred to the Town or Parish Council for the area in which the properties were located as a first phase of the Local Service Delivery – Transfer and Devolution to Town and Parish Councils process.  Bollington War Memorial had not been included in that list but has since been identified as an appropriate asset to be devolved to the Town Council.  The 125 year lease to Bollington Town Council would be based upon the standard heads of terms and, and as it would prohibit change of use of the War Memorial, no overage agreement was required.

 

As the War Memorial is in open space it would be necessary to advertise the potential disposal of the Garden under the provision of the Local Government Act. 

 

RESOLVED:

 

That, subject to the response to the public space advertisements, Bollington War Memorial, Palmerston Street, Bollington, Cheshire, SK10 5PZ be transferred to Bollington Town Council by way of 125 year lease on the terms as stated in the report and other terms to be agreed by the Property Services Manager.

To consider a request to transfer Congleton Community Garden by way of 125 year lease to Congleton Town Council as part of the Local Service Delivery -Transfer and Devolutions to Town and Parish Councils process

That, subject to the response to the public space advertisements, Congleton Community Garden, High Street/Lawton Street, Congleton, Cheshire, CW12 3AE be transferred to Congleton Town Council by way of 125 year lease on the terms as stated in the report and other terms to be agreed by the Property Services Manager.

Minutes:

Consideration was given to a request from Congleton Town Council for the Community Garden to be transferred to their ownership via a lease so as to enable them to apply for a grant application from the Heritage Lottery Fund to refurbish the Garden and Cenotaph. 

 

It had previously been decided by Cabinet that a number of properties should be transferred to the Town or Parish Council for the area in which the properties were located as a first phase of the Local Service Delivery – Transfer and Devolution to Town and Parish Councils process.  Congleton Community Garden had not been included in this list but has since been identified as an appropriate asset to be devolved to the Town Council.  The 125 year lease to Congleton Town Council will be based upon the standard heads of terms and, as it will prohibit change of use of the Garden, no overage agreement will be required.

 

As the Garden is open space it will be necessary to advertise the potential disposal of the Garden under the provision of the Local Government Act.  The adverts have been placed in the press and the period for representations to be made will expire on 31 July 2014.
