55.	Apologies for Absence View the background to item 55. Minutes: There were no apologies for absence.
56.	Declarations of Interest View the background to item 56. To provide an opportunity for Members and Officers to declare any disclosable pecuniary and non-pecuniary interests in any item on the agenda. Minutes: Minute No 58 (Kings School Governors, Macclesfield) - Councillor Paul Findlow declared a non-pecuniary interest by virtue of being a Governor at the School.
57.	Public Speaking Time/Open Session View the background to item 57. In accordance with Procedure Rules Nos.11 and 35 a period of 10 minutes is allocated for members of the public to address the Sub-Committee on any matter relevant to its work. Individual members of the public may speak for up to 5 minutes but the Chairman or person presiding will decide how the period of time allocated for public speaking will be apportioned where there are a number of speakers. Members of the public are not required to give notice to use this facility. However, as a matter of courtesy, a period of 24 hours’ notice is encouraged. Members of the public wishing to ask a question at the meeting should provide at least three clear working days’ notice in writing and should include the question with that notice. This will enable an informed answer to be given. Minutes: No members of the public were present.
58.	King’s School Governors - Macclesfield View the background to item 58. Councillor David Neilson has notified the Council that he has resigned from his King’s School Governors appointment. The appointment of Governors to the King’s School, Macclesfield is a category two appointment. In accordance with the Casual vacancy procedure, it falls to the same political group to make a replacement nomination. The Leader of the Liberal Democrat Group, Cllr Fletcher has been contacted and asked whether his group wishes to make an appointment. If the group chooses not to make an appointment the procedure then requires that other Groups be invited to make a nomination. As this is a recent resignation, it has not been possible to establish whether the Liberal Democrat group wish to make an appointment. If they do not, other groups will be contacted and an update on the position will be given at the meeting. Minutes: Councillor Paul Findlow had declared a non-pecuniary interest in this item. Consideration was given to filling a vacancy on the Board of Governors of the King’s School which had arisen due to the recent resignation of Councillor David Neilson. In accordance with the established casual vacancy procedure the Leader of the relevant political group had been asked to provide a replacement; the Liberal Democrat Group had, however, indicated that it did not wish to provide a replacement at this time. Following consultation with the remaining political groups a nomination had been received from the Independent Group for the vacancy to be filled by Councillor Brendan Murphy. It was agreed that additional time was needed for the matter to be fully considered by the remaining political groups. RESOLVED That any additional nominations be sought from the Conservative and Labour Groups and that the matter then be referred to the Constitution Committee for a decision to be made.
59.	Cheshire East Local Access Forum View the background to item 59. To note the following :- Councillor Rhoda Bailey was the elected member on the Cheshire Local Access Forum, a statutory advisory body to the Cheshire East Council and Cheshire West and Chester Council. Cheshire West and Chester Council gave notice of their intention to withdraw from the joint Forum in order to set up their own Forum, to match the Council’s geographic area. Therefore, a Cheshire East Local Access Forum has been established. It is intended to appoint less than 16 members and it is, therefore, considered appropriate to appoint one Councillor from Cheshire East. The Leader of the Conservative Group has indicated that he wishes Cllr Rhoda Bailey to continue as the Council’s representative. Minutes: The Sub-Committee was asked to note that for some time Councillor Rhoda Bailey had been the elected member on the Cheshire Local Access Forum, a statutory advisory body to the Cheshire East Council and Cheshire West and Chester Council. Cheshire West and Chester Council had, however, given notice of their intention to withdraw from the joint Forum in order to set up their own which would match its geographic area. A Cheshire East Local Access Forum had, therefore, also been established to which it was intended to appoint less than 16 members. It was considered appropriate to appoint one Councillor from Cheshire East and the Leader of the Conservative Group had indicated that he wished Cllr Rhoda Bailey to continue as the Council’s representative. RESOLVED That Councillor Rhoda Bailey be approved as this Councils representative on the newly formed Cheshire East Local Access Forum.
60.	Request for Cheshire East Council Representation PDF 68 KB View the background to item 60. To consider a Request for Cheshire East Council Representation on the Sandbach Traders Association (STAR). Additional documents: Constitution of STARv2 , item 60. PDF 67 KB Minutes: Consideration was given to a request from the Sandbach Traders and Retailers Association (STAR) to be added to the list of approved outside organisations, and for a member of the Council to be appointed to it. The report set out the established procedure for considering such applications, including the approved criteria against which the aims and purpose of the organisation needed to be assessed. The Constitution and rules of STAR were appended to the report. The Sub-Committee was satisfied that the organisation fulfilled (c) and (e) of the necessary criteria and that the Constitution Committee should be recommended to add it to the list of Category 2 organisations appointed by that Committee. In addition STAR had requested that in the event of the application for inclusion being agreed Councillor Barry Moran should be the Councils representative; he had been attending meetings as a Ward Member, on an informal basis. The Sub-Committee supported this request and agreed that it be submitted to the Constitution Committee for approval. RESOLVED That the Constitution Committee be recommended to add Sandbach Traders and Retailers Association to list of Category 2 Outside Organisations and that Councillor Barry Moran be appointed as this Councils representative.
