Appointment of Chairman

To appoint a chairman for the meeting.

Minutes:

It was moved and seconded that Councillor R Domleo be appointed as Chairman for the meeting

 

RESOLVED:

 

That Councillor R Domleo be appointed as Chairman for the meeting.

2.

Declarations of Interest

To provide an opportunity for Members and Officers to declare any disclosable pecuniary and non-pecuniary interests in any item on the agenda.

Minutes:

Councillor J Jackson declared a non-pecuniary interest that she was a member of GMB.

3.

Exclusion of the Press and Public

The reports relating to the remaining items on the agenda have been withheld from public circulation and deposit pursuant to Section 100(B)(2) of the Local Government Act 1972 on the grounds that the matters may be determined with the press and public excluded.

 

The Committee may decide that the press and public be excluded from the meeting during consideration of the following items pursuant to Section 100(A)4 of the Local Government Act 1972 on the grounds that they involve the likely disclosure of exempt information as defined in Paragraphs 1 and 2 of Part 1 of Schedule 12A to the Local Government Act 1972 and public interest would not be served in publishing the information.

RESOLVED:

 

That the press and public be excluded from the meeting during consideration of the following item, pursuant to Section 100(A)(4) of the Local Government Act 1972 as amended, on the grounds that it involved the likely disclosure of exempt information as defined in Paragraphs 1 and 2 of Part 1 of the Schedule 12A of the Local Government Act 1972 and the public interest would not be served in publishing this information.

Disciplinary Appeal

The Sub Committee to consider the case presented by Management and the Appellant and reach a decision regarding whether or not the decision taken to dismiss the Appellant was fair and reasonable in the circumstances.  The Sub Committee should also consider whether the Council’s Attendance Management Policy and Procedure have been followed.

Minutes:

Members of the Sub-Committee gave very careful consideration to the evidence presented to them and the representations made by the appellant and management and also considered whether the Council’s Attendance Management Policy and Procedure had been followed.

 

RESOLVED:

 

That the appeal be upheld and the Appellant be reinstated in order to facilitate consideration by Management together with the Appellant and OHU, of whether there are any alternative roles within the service which, with reasonable adjustment, the Appellant could undertake and thereafter if such a post is identified the Appellant to undertake a trial period.  The Sub Committee recognised the considerable efforts made by Management to date.
