Appointment of Chair

To appoint a Chair for the meeting.

That Councillor A Moran be appointed as Chair for the meeting.

14.

Declaration of Interests

To provide an opportunity for Members and Officers to declare any disclosable pecuniary interests, other registerable interests, and non-registerable interests in any item on the agenda and for Members to declare if they have pre-determined any item on the agenda.

There were no declarations of interest.

15.

Exclusion of the Press and Public

The reports relating to the remaining items on the agenda have been withheld from public circulation and deposit pursuant to Section 100(B)(2) of the Local Government Act 1972 on the grounds that the matters may be determined with the press and public excluded.

 

The Committee may decide that the press and public be excluded from the meeting during consideration of the following items pursuant to Section 100(A)4 of the Local Government Act 1972 on the grounds that they involve the likely disclosure of exempt information as defined in Paragraphs 1 and 2 of Part 1 of Schedule 12A to the Local Government Act 1972 and public interest would not be served in publishing the information.

That the press and public be excluded from the meeting during consideration of the following items pursuant to Section 100(A) 4 of the Local Government Act 1972 as amended on the grounds that they involved the likely disclosure of exempt information as defined in Paragraphs 1 and 2 of Part 1 of Schedule 12A of the Local Government Act 1972 and public interest would not be served in publishing the information.

Consideration of Fitness to hold a Joint Hackney Carriage / Private Hire Driver Licence

To consider the report.

Minutes:

The Sub-Committee considered a report regarding whether the license holder remained a fit and proper person to be the holder of a Joint Hackney Carriage/Private Hire Driver Licence.

 

The licence holder had been the subject to two complaints and had refused to attend an interview to discuss the complaints unless the complainant was obliged to attend also.

 

The matter was referred to Licensing Sub Committee to determine the future of their Joint Driver licence with Cheshire East Council.

 

The licence holder and complainant both attended the hearing and made representations in respect of the case.

 

After a full hearing, and in accordance with the rules of procedure, the Chair of the Sub-Committee reported that, after taking account of all the evidence, including multiple previous warnings which had not led to sustained improvement, the following course of action had been agreed.

 

RESOLVED: (Unanimously)

 

To suspend the Joint Hackney Carriage/Private Hire Driver Licence under section 61(1)(b) of the 1976 Act (“any other reasonable cause”) for 28 days. The subcommittee strongly recommended that the driver should attend an anger management course as soon as possible to avoid similar incidents occurring in the future.
