Purpose:

The programme of refurbishment and reconfiguration works to Macclesfield Market, is to be funded by the UK Shared Prosperity Funding (UKSPF), the funding from which must be spent by end March 2025. To allow for an eight-month construction period, construction works must commence during September 2024. The construction works will be phased to allow Market Traders to continue to trade during the construction period, with Traders relocated into temporary stalls. Following completion of works, Market Traders will occupy wholly new stalls, in different locations to their present stalls.

 

New occupational agreements are required with all Market Traders for the project to proceed, as the current agreements do not allow for Traders to be relocated to different stalls than presently occupied. The new agreements will be in the form of Licence Agreements to allow for temporary occupations with Leases (secure business tenancies) granted for the new stalls following completion of works. The Leases will be contracted under Agreements for Lease. All agreements must be contracted before commencement of works otherwise the project cannot proceed.

Decision:

Approval to enter into the following occupational agreements: -

 

·       Licence Agreements (contracted-out of Sections 24 to 28 of the Landlord and Tenant Act 1954) with Market Traders in relation to temporary stalls within Macclesfield Indoor Market, Mill Street, Macclesfield whilst refurbishment works are undertaken by the Council; and

 

·       Agreements for Lease to grant new three-year leases to Market Traders for stalls within Macclesfield Indoor Market, Mill Street, Macclesfield following completion of the refurbishment works.
