The Licensing Act 2003 requires that Licensing Authorities prepare and publish a statement of policy that they propose to apply when exercising their functions under the Act during the five year period to which the statement applies.
The Council is required to review its existing statement of principles and publish the revised version by no later than 31January 2014. In preparing a revised statement the Council must undertake a consultation exercise with stakeholders, including a number of specific agencies, and give appropriate weight and consideration to any responses received.
Changes to the current policy include providing updated and additional information on how the Licensing Authority will promote the licensing objectives, and changes to take into account recent changes in legislation.
That approval be given to consult on the draft revised Licensing Policy as set out in Appendix 1 of the report, subject to: -
1. The deletion of paragraph 19.2
2. The existing paragraph 19.3 to be renumbered 19.2
3. The addition of a new paragraph 19.3 to state that “The Council will consider implementing a late night levy if appropriate”.
