The Cabinet Member considered a report on the various legislative provisions in respect of street naming and numbering.
The Council had legal responsibilities in relation to the naming of streets and the numbering of properties. It was necessary for the Council to formalise the position in relation to the specific pieces of legislation used by the Council in relation to street naming functions.
The relevant legislation provided a number of options which were open to the Council in relation to street naming. With respect to the naming of streets, section 17 of the Public Health Act 1925 could be adopted without conflict with any other legislation provision. In relation to the alteration of street names, the Council could adopt either section 21 of the Public Health Act 1925 or section 18 of the Public Health Act 1925.
In relation to street name plates and penalties for damage to such name plates or the use of unapproved street names, the Council could adopt either sections 64 & 65 of the Town Improvement Clauses Act 1847 or section 18 of the Public Health Act 1925. A detailed breakdown of the legislation was provided within the appendix to the report.
In order to adopt the legislation, the Council would be required to provide public notice of the intention to adopt in a local newspaper for two consecutive weeks. Notice would also need to be served on every parish council or community council affected, or where appropriate to the chairman of a parish meeting.
RESOLVED
That the Cabinet Member for Environmental Services
(1) notes the legislative provisions in respect of the numbering of properties as set out within the report;
(2) expresses the intention to pass a resolution to adopt the following legislation in relation to street naming:
(i) section 17 of the Public Health Act 1925
(ii) section 21 of the Public Health Acts Amendment Act 1907; and
(iii) section 19 of the Public Health Act 1925.
(3) authorises the giving of notice of the Council’s intention to pass a resolution to adopt the legislation referred to in (2) above to be given as required by paragraph 25 of Schedule 14 to the Local Government Act 1972.
