The Sub-Committee considered a report for an application for a new Premises Licence; 15 Market Place, Macclesfield SK10 1AG – Heist Bar Company Limited.

After a full hearing of the application and in accordance with the rules of procedure, the Chair of the Sub-Committee reported, that after taking account of:
• The oral and written representations made by all parties to the hearing.
• The licensing objective of the prevention of public nuisance.
• The Secretary of State’s Guidance under the Licensing Act 2003 (Dec 2022).
• Cheshire East Council’s Statement of Licensing Policy
The following course of action had been agreed:
RESOLVED:
That the application for a premises licence be GRANTED as set out in the Operating Schedule accompanying the application, any mandatory conditions that must be included on the licence in accordance with the Licensing Act 2003, and the following additional conditions
Additional Conditions:
Prevention of Public Nuisance
1. No live music shall be performed on the first-floor outdoor terrace after 21:00 hours on any day.
2. No recorded music shall be played on the first-floor outdoor terrace after 22:30 hours on any day.
3. No amplified live or amplified recorded music shall be played on the outdoor terrace after the terminal hours stated in Conditions 1 and 2 above.
4. All outdoor speakers shall be turned off at 22:30 hours and shall remain off until the start of permitted hours on the following day.
5. The first-floor outdoor terrace shall not be used by patrons after 23:00 hours on any day.
6. From 19:00 daily, a trained member of staff shall monitor the terrace to manage patron behaviour, prevent noise breakout (especially shouting and singing) and ensure compliance with conditions 1–5 above.
7. A Noise Management Plan (NMP) shall be prepared and maintained, covering the use of the terrace, management of customers using the area, control of music levels, and handling of noise complaints. The NMP shall be made available to the Licensing Authority or Environmental Health on request.
8. A log (paper or digital) shall record the date/time/nature of any noise or nuisance complaint, the duty manager, actions taken and outcomes. Entries shall be made within 24 hours and kept for 12 months for inspection by authorised officers.
9. The terrace shall operate as a non-smoking area. Patrons wishing to smoke or vape must exit the premises to do so.
10. Access doors to the terrace shall be kept closed when not in use, except for normal access and egress.
11. Deliveries, waste collections and recycling (including bottle skips) shall not take place between 23:00–07:00 (and 09:00 on Sundays/Bank Holidays), except in an emergency.
12. No movement of bottles or waste to external receptacles shall take place between 22:00– 08:00.
13. On a date to be agreed between the Designated Premises Supervisor and the Licensing Authority, the DPS shall attend a liaison meeting with the Licensing Authority and Environmental Health to review the management of noise and the dispersal policy at the premises. This meeting should occur no sooner than 6 months, and no later than 9 months, from the date of opening of the premises. A brief written note of actions agreed at this meeting shall be kept at the premises and should be available for subsequent inspection by authorised officers. Dispersal
14. A written Dispersal Policy shall be in place prior to opening and thereafter maintained, addressing the gradual wind-down of music and service prior to terminal hours; staff deployment at exits; management of queueing and taxis; signage and staff messaging to encourage quiet departure; and coordination with door staff (if employed). The policy shall be available to authorised officers on request.
15. On Fri–Sat from 22:00 until close, at least 2 SIA-licensed door supervisors shall be deployed to manage dispersal and reduce late-night noise.
16. All persons are to be requested to leave the premises quietly and with consideration to residents and signage must be displayed at exits to the premises to encourage quiet departure by customers. Staff training
17. All relevant staff shall receive induction and refresher training on the NMP, Dispersal Policy, underage drinking policy, and incident reporting. Training records shall be retained for inspection.
