2.

Public Speaking Time/Open Session

In accordance with Procedure Rules Nos.11 and 35 a period of 10 minutes is allocated for members of the public to address the meeting on any matter relevant to the work of the meeting. Individual members of the public may speak for up to 5 minutes but the Chairman or person presiding will decide how the period of time allocated for public speaking will be apportioned where there are a number of speakers. Members of the public are not required to give notice to use this facility. However, as a matter of courtesy, a period of 24 hours’ notice is encouraged.

 

Members of the public wishing to ask a question at the meeting should provide at least three clear working days’ notice in writing and should include the question with that notice. This will enable an informed answer to be given.

To consider a report on the adoption of the Policy for the Allocation of Community Grants and the maximum amounts payable under the scheme for 2011/12; the funding allocations for key infrastructure groups for the forthcoming year; and the transfer of responsibility for a number of payments.

The Cabinet Member for Performance and Capacity considered a report on the adoption of the Policy for the Allocation of Community Grants and the maximum amounts payable under the scheme for 2011/12; the funding allocations for key infrastructure groups for the forthcoming year; and the transfer of responsibility for a number of payments.

 

Cheshire East Council had adopted a Community Grants Policy for 2009/10 and 2010/11which had now been reviewed. To enable the grants scheme for the next and subsequent financial years to continue, a Policy needed to be agreed and maximum funding amounts set. In addition, a number of decisions needed to be made as regards funding allocations to infrastructure organisations and on the future funding for other organisations which were currently the responsibility of the Performance and Partnerships Service.

 

RESOLVED

 

That

 

(1)   the Policy for the Allocation of Community Grants for 2011/12 and subsequent financial years be approved and the maximum amounts payable under the scheme for 2011/12 be as follows:

 

            Facilities        £3,000

            Activities           £500

            Events               £250

 

(2)   the funding allocations for key infrastructure groups for the forthcoming year be approved; and

 

(3)   responsibility for a number of payments be transferred from/to Performance & Partnerships and other Services.

To consider a report seeking approval, subject to statutory consultation, for the appointment of certain hackney carriage stands in Macclesfield and Wilmslow.

The Cabinet Member for Safer and Stronger Communities considered a report seeking approval, subject to statutory consultation, for the appointment of certain hackney carriage stands in Macclesfield and Wilmslow.

 

On 7th March 2011 the Licensing Committee had been requested to consider a report which included a decision to make recommendations to the Cabinet Member about the proposed appointment of hackney carriage stands (or ‘ranks’) in Wilmslow and Macclesfield. The procedure relating to the appointment of hackney carriage stands was set out within section 63 of the Local Government (Miscellaneous Provisions) Act 1976 (‘the 1976 Act’).

 

Details had provided of limitations within two traffic regulation orders, made under the Road Traffic Regulation Act 1984, relating to hackney carriage stands in Wilmslow and Macclesfield. Having considered the factors within section 63(5) of the 1976 Act, the Licensing Committee had resolved to recommend to the Cabinet Member the decisions set out below, in order to bring the designation of stands under section 63 of the 1976 Act in line with the provisions of the relevant traffic regulation orders.

 

In accordance with section 63 of the 1976 Act, a notice of the proposed stands had to be given to the Chief Officer of Police and had to be published in a local newspaper, making provision for any objections or representations to be made within 28 days. Any objections or representations received had to be taken into consideration before a final decision was made.

 

RESOLVED

 

That

 

(1)   the Borough Solicitor, or an officer acting on her behalf, be authorised to provide notice in accordance with the requirements of section 63 of the Local Government (Miscellaneous Provisions) Act 1976, in relation to the proposed appointment of hackney carriage stands set out in paragraph 10.5 of the report at Appendix 1 (and illustrated within Appendices 1, 2 & 3 of the report);

 

(2)   Officers be authorised to seek the consent of the Highway Authority in relation to the proposed appointment of hackney carriage stands set out within paragraph 10.5 of the report at Appendix 1 (and illustrated within Appendices 2, 3 & 4 of the report);

 

(3)   subject to the consent of the Highway Authority being received, if no objections or representations are received within the statutory consultation period, the appointment of the hackney carriage stands come into effect on the day after the last day of the consultation period; and

 

(4)   it be noted that if objections or representations are received during the statutory consultation period, these will be reported to a subsequent meeting for consideration.
