Minutes: The committee considered an application to review a Premises Licence made under the Licensing Act 2003 for The Dolphin, 76 Windmill Street, Macclesfield, SK11 7HS.

After a full hearing of the application and in accordance with the rules of procedure, the Sub-Committee determined that it was appropriate to modify the premises licence by imposing additional conditions for the promotion of the licensing objectives, in particular the prevention of public nuisance.
The Sub-Committee did not consider it appropriate or proportionate to take further steps such as suspension or revocation of the licence.
RESOLVED: -
That the Sub Committee agreed that it was appropriate to modify the premises licence by imposing additional conditions for the promotion of the licensing objectives as listed below:
Prevention of Public Nuisance
1. Where live music constitutes regulated entertainment requiring authorisation under the Licensing Act 2003, the Designated Premises Supervisor shall ensure that the volume of such entertainment is controlled so as to prevent noise nuisance arising at nearby residential properties.
2. All external doors and windows shall be kept closed during any regulated entertainment, except for the purposes of access and egress.
3. The premises licence holder shall, within 28 days of the date of this notice, submit to the Licensing Authority for approval (in consultation with Environmental Health) details of a scheme of works to control noise transmission through the party wall shared with adjoining residential premises. The scheme shall be based on an assessment of noise transmission and shall include the installation of appropriate sound insulation measures designed to prevent noise from the premises causing a nuisance at the adjoining residential property. The scheme of works shall specify the type, extent and location of sound insulation measures to be installed. The premises licence holder shall implement the approved scheme of works in full within a timescale to be agreed in writing by the Licensing Authority. Following implementation, the sound insulation measures shall be maintained in good working order, and the premises shall be operated so that noise transmitted through the party wall does not cause a nuisance at the adjoining residential property.
