Public Speaking Time/Open Session

In accordance with Procedure Rules Nos.11 and 35 a period of 10 minutes is allocated for members of the public to address the meeting on any matter relating to the work of the body in question.  Individual members of the public may speak for up to 5 minutes but the Chairman or person presiding will decide how the period of time allocated for public speaking will be apportioned where there are a number of speakers. Members of the public are not required to give notice to use this facility. However, as a matter of courtesy, a period of 24 hours’ notice is encouraged.

 

Members of the public wishing to ask a question at the meeting should provide at least three clear working days’ notice in writing and should include the question with that notice. This will enable an informed answer to be given.

Decision:

That the unconditional offer from Bartholomew Homes be accepted, and that Legal Services be instructed to proceed to legal completion on terms and conditions to be agreed by the Assets Manager and the Head of Legal Services and Monitoring Officer.

 

 

Minutes:

Consideration was given to the disposal of this property and land which was surplus to the requirements of Cheshire East Borough Council and had been actively marketed, seeking unconditional bids, for a period of over 6 months.  It is situated within a predominantly residential area and pre marketing it was considered residential development would achieve best value in line with current planning requirements. The proposed disposal is unconditional and it will be a matter for the buyer to ensure that it secures planning permission for its proposed future use.

 

Bartholomew Homes submitted the highest fully funded unconditional offer for the site; they have provided a plan of their proposed scheme of 21 residential dwellings. 

 

Section 123 of the Local Government Act 1972 provides that a local authority may dispose of land in any manner they see fit subject to it obtaining the best price reasonably obtainable for the transaction.  In this case the Council has marketed the property and the Council’s Property Services Manager can certify that the sale price represents best consideration.

 

RESOLVED

 

That the unconditional offer from Bartholomew Homes be accepted, and that Legal Services be instructed to proceed to legal completion on terms and conditions to be agreed by the Assets Manager and the Head of Legal Services and Monitoring Officer.
