To consider the above application. Additional documents: Minutes: Consideration was given to the above planning application.
It was reported that Cheshire East Council had received a letter from the Secretary of State for Housing, Communities and Local Government stating that they had received a request for a Tree Preservation Order on the site and that Council could not grant planning permission for the scheme without their authorisation. In response the Head of Planning stated that it was not unusual to receive a holding direction, and it did not preclude the Strategic Planning Board making their own decision on the planning application.
The following attended the meeting and spoke in relation to the application: Councillor Hayley Whitaker (ward councillor), Poynton Town Councillor Laurance Clarke, Councillor Mike Sewart (neighbouring ward councillor), Mr Mike Ellison (objector), Mr Stewart Tennant (objector), Mr Alan Brown (on behalf of applicant) and Mr Ashley Stratford (agent).
That the application be REFUSED, contrary to officer recommendation for the following reasons:
1 contrary to Policy ENV6 of the Site Allocation and Development Policy due to loss of trees and absence of replacement on the site.
2 contrary to Policy SE12 of the Cheshire East Local Plan as not sufficient evidence submitted to show that tree removal would not damage the embankment stability.
In the event of any changes being needed to the wording of the Board’s decision (such as to delete, vary or add conditions / informatives / planning obligations or reasons for approval / refusal) prior to the decision being issued, the Head of Planning has delegated authority to do so in consultation with the Chair of the Strategic Planning Board, provided that the changes do not exceed the substantive nature of the Committee’s decision.
