02/06/2020 - Property and Land Transfer at Sandbach High School ref: 2375    Recommendations Approved

The Portfolio Holder is asked to approve the outstanding transfer of the legal title to the freehold land and buildings to the academy trust with responsibility for Sandbach High School as part of the statutory transfer of educational property and to approve the transfer of the freehold title to land and buildings comprising the ground floor changing room, section of corridor linking the school and leisure centre, and a strip of external land underneath the canopied area to the Trust.

Decision:

That the Portfolio Holder

 

1.         approve the transfer of the legal title of the School Land to the Trust in accordance with statutory provisions.

2.         approve the undertaking of an Equality Impact Assessment and a public consultation on the proposal to transfer the Additional Areas, which were not part of the original Adjudicators determination, as set out in this report.

3.         Subject to the outcome and further consideration of any responses received as a result of the EIA and the public consultation,  authority is delegated to the Head of Estates in consultation with the Portfolio Holder for Environment and Regeneration:-

3.1     to approve varying the lease (by surrender of part of the lease) with Everybody Sport and Recreation to release the Additional Areas and enable those areas to be transferred freehold to the Trust.

3.2     to approve the transfer of the freehold of the Additional Areas to the Trust once those areas have been surrendered from the Everybody Sport and Recreation lease.

3.3     to authorise the Council to enter into a surrender agreement with the Trust in respect of its use of the PE classroom.

3.4     to authorise the Council to complete all legal documentation associated with the above approvals.

3.5     if there are objections made to the proposals as a result of the public consultation and those objections cannot be overcome or resolved and they genuinely relate to the disposal of the Additional Areas then those objections will be reviewed by the Portfolio Holder before a final decision is made in this regard.

3.6      if the results of the EIA raises any concerns in relation to the transfer of the Additional Areas and those concerns cannot be overcome or resolved then the matters raised will be reviewed by the Portfolio Holder before a final decision is made in this regard.
