Decisions

The original Marton Neighbourhood Plan was subject to a referendum and made by the Council on 29th November 2016. The made Plan has now been reviewed and updated. The Plan has been subjected to independent examination and the review process has resulted in a number of modifications to the original Plan.  To implement those modifications and bring the updated plan into effect, the Council must now make the updated Marton Modification Neighbourhood Plan and revoke the original neighbourhood plan.

That the Portfolio Holder:

1          confirms that the Marton Neighbourhood Plan, made on 29^th November 2016 is revoked.

2          accepts the Examiner’s recommendations to make modifications to the Marton Modification Neighbourhood Plan as set out in the Examiner’s report.

3          confirms that the Marton Modification Neighbourhood Plan is now made, and forms part of the Development Plan for Cheshire East and

4          confirms that the Council will use the Marton Modification Neighbourhood Plan in planning decisions, giving policies significant weight so far as they are material to planning applications within the Marton Neighbourhood Area.

The Hankelow Neighbourhood Development Plan was submitted to the Council in September 2020 and, following a statutory publicity period, proceeded to independent examination.  The Examiner’s report has now been received and recommends that, subject to modifications, the Plan proceed to referendum.

That the Portfolio Holder:

1          accepts the examiner’s recommendations to make modifications to the Hankelow Neighbourhood Plan as set out in the examiner’s report.

2          confirms that it is the Councils intent to hold a referendum on the Hankelow Neighbourhood Plan (as amended), within the Hankelow Neighbourhood Plan area, at the earliest opportunity available after the current restrictions on polling are lifted.

3          confirms that the Council will use the Hankelow Neighbourhood Plan in planning decisions, giving policies significant weight so far as they are material to planning applications within the Hankelow Neighbourhood Area.

Consideration was given to the above report.

Parish Councillor Paul Morgan, representing Goostey Parish Council, Councillor Andrew Kolker, the Ward Councillor, Dr Ken Morris, an objector and Lynn Jones, the agent for the applicant attended the virtual meeting and spoke in respect of the application).

RESOLVED

That the application be refused for the following reason:-

It has not been demonstrated that the proposal is essential in order to expand or redevelop the business and cannot reasonably be located on a site within an existing settlement as per the requirements of CELPS policy EG1, EG2, CO1 and SD1; and as such it has not been demonstrated that the proposal falls within any of the exceptions set out in Policy PG 6 of the Cheshire East Local Plan Strategy and Policy PS8 of the Congleton Borough Local Plan First Review, for development in the Open Countryside.

In order to give proper effect to the Strategic Planning Board’s intent and without changing the substance of its decision, authority is delegated to the Head of Planning in consultation with the Chairman (or in their absence the Vice Chairman) to correct any technical slip or omission in the resolution, before issue of the decision notice.

It was noted that the Board’s request for the enforcement team to look at the appropriateness of enforcement action as a matter of urgency should be included within the minutes.
